Terms of Use

These Terms of Use (“Terms”) are an agreement between you and Bhogi AI, Inc. (“Bhogi,” “we,” “us”) covering your use of the Bhogi mobile app and related services (the “Services”). By creating an account or using the Services, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Services.

1. Who Can Use Bhogi

You must be at least 13 years old to use Bhogi. You are responsible for keeping your account secure and for everything that happens under it.

2. What Bhogi Does

Bhogi recommends dishes at nearby restaurants based on your taste preferences and allergens, and lets you connect with friends and invite them to meals. Restaurant, menu and allergen information comes from third parties and from users. It may be incomplete or out of date. Bhogi is not a source of medical or dietary advice. Always confirm allergens with the restaurant before ordering.

3. Your Content

“Your content” means anything you submit to Bhogi: your name, notes on dinner invites, ratings and feedback. You keep ownership of your content. You give Bhogi a worldwide, non-exclusive, royalty-free licence to host, store, display and share your content in order to operate and improve the Services — for example, showing your name to friends and your note to the person you invite.

4. Zero Tolerance for Objectionable Content and Abusive Users

Bhogi has zero tolerance for objectionable content and abusive behaviour. You agree not to post, send or share content, or behave in a way, that:

• harasses, bullies, threatens or intimidates anyone;
• is hateful or discriminatory toward any person or group based on race, ethnicity, national origin, religion, sex, gender identity, sexual orientation, disability, age or any other protected characteristic;
• is sexually explicit, obscene or pornographic, or sexualises minors in any way;
• promotes violence, self-harm, or illegal activity;
• is spam, a scam, or impersonates another person or organisation;
• invades someone’s privacy, including sharing their personal information without their permission;
• infringes anyone’s intellectual property or other rights.

Reporting and blocking. You can report any user or dinner invite from within the app, and you can block any user so they can no longer find you, send you friend requests, or invite you. We review every report within 24 hours. When content breaks these Terms, we remove it, and we suspend or permanently remove the account of the user who posted it. We may do so without notice. 5. Acceptable Use

You agree not to misuse the Services. That includes: accessing them by automated means, interfering with their operation or security, reverse engineering them except where the law allows, or using them in violation of any law.

6. Inviting Contacts

If you invite someone from your contacts, you confirm that you know them and that they would reasonably expect to hear from you. Invitations are sent from your own messaging app, by you.

7. Termination

You can delete your account at any time in the app under Profile → Delete account. We may suspend or end your access at any time if you break these Terms, or if we need to in order to protect other users, Bhogi or the public.

8. Disclaimers

The Services are provided “as is” and “as available.” To the fullest extent the law allows, Bhogi disclaims all warranties, express or implied, including fitness for a particular purpose, and does not guarantee that recommendations, restaurant details or allergen information are accurate. Restaurants are independent businesses; Bhogi is not responsible for their food, service or premises.

9. Limitation of Liability

To the fullest extent the law allows, Bhogi will not be liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of data, profits or goodwill, arising from your use of the Services. Our total liability for any claim is limited to the greater of US$100 or the amount you paid us in the 12 months before the claim.

10. Apple

If you downloaded Bhogi from the Apple App Store: these Terms are between you and Bhogi only, not Apple. Apple has no obligation to provide maintenance or support for the app, and is not responsible for addressing any claims relating to it. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.

11. Changes

We may update these Terms. If a change is material, we will tell you in the app or by email before it takes effect. If you keep using the Services after that, you accept the updated Terms.
